The National Commission for Persons with Disabilities (NCPWD) has expressed strong displeasure over reports that some airlines operating in Nigeria deny persons with disabilities the right to fly, particularly on what the airlines describe as “small travel jets.”
The Commission notes with concern that such actions amount to discrimination and a clear violation of both international aviation standards and Nigerian law. Airlines are reminded that global best practices, as outlined by the International Air Transport Association (IATA), require carriers to provide safe, dignified, and non-discriminatory services to all passengers, including persons with disabilities.
The NCPWD further draws attention to the Discrimination Against Persons with Disabilities (Prohibition) Act, 2018. Section 14(1) of the Act expressly mandates all airlines operating in Nigeria to ensure the accessibility of their aircraft to persons with disabilities and to accord them priority during boarding and disembarkation.
The Commission stresses that failure to comply with these legal provisions will attract appropriate sanctions as clearly stated in the law.
NCPWD describes the refusal to board persons with disabilities on certain aircraft as an infringement on their fundamental rights and an unacceptable practice in a society that claims to uphold inclusivity and equality.
The Commission believes that no circumstance should undermine Nigeria’s commitment to accessibility and inclusiveness, especially following the passage of the Discrimination Against Persons with Disabilities (Prohibition) Act in 2018.
It warns that any form of oversight or neglect by service providers in this regard will be viewed as a direct violation of the rights of persons with disabilities.
The Commission adds that repeated complaints, inconveniences, and emotional distress suffered by affected individuals risk rendering the Prohibition Act meaningless if left unaddressed.
NCPWD also considers such discriminatory practices a serious setback to efforts aimed at promoting accessibility and inclusivity within the aviation industry.
As an institution mandated to protect and promote the rights of persons with disabilities, the Commission maintains that accessibility must be a top priority in all sectors, including air and land transportation.
The National Commission for Persons with Disabilities therefore calls on relevant authorities to investigate these reports thoroughly and ensure concrete measures are put in place to prevent future occurrences. The Commission also urges all stakeholders to join hands in promoting a truly inclusive and accessible Nigeria for all citizens.
